Memorandum of Consultations
Representatives of the Government of the United States of America
and representatives of the Government of the Argentine Republic met in
Washington, D.C ., March 20-22, 2007, to discuss expanding and
modernizing their civil aviation relationship . These discussions were held in
a warm and cooperative atmosphere . Delegation lists are included at
Attachment A.
The delegations reached agreement, ad referendum, to amend the
1985 U.S .-Argentina Air Transport Services Agreement, as amended (the
"Agreement") . A copy of the draft Protocol of Amendment, initialed by the
heads of both delegations, is included at Attachment B . The delegations
intend to recommend the draft Protocol to their respective authorities for
signature, with the goal of its entry into force in the near future .

The delegations intend that the final sentence of paragraph 4 of the
new security article in the draft Protocol of Amendment be translated into
Spanish as "Cada Parte considerara con buena disposicion toda solicitud de
la otra Parte encaminada a que se tomen medidas especiales de seguridad
para confrontar alguna amenaza en particular ."

The United States delegation reiterated its view that the Government
of Argentina is not in compliance with the Agreement by permitting
discriminatory user charges at Buenos Aires International Airport (Ezeiza)
and requested that the Government of Argentina enforce user fees that do
not discriminate between U.S . and Argentine carriers . In this regard, the
Argentine delegation stated its view that there is no discriminatory treatment
towards U.S . carriers in Argentina because the same fees are set for
Argentine and foreign carriers, and that therefore the Government of
Argentina is in compliance with the Agreement .

The United States delegation also expressed its concerns regarding
high fees, the quality of services, recent radar problems, and monopoly
ground handling at Ezeiza . The Argentine delegation took note of the
comments of the United States delegation and intends to convey them to the
competent Argentine authorities .

at their next meeting.
