U.S. Assistance and the International Criminal Court

Question:   Will the United States assist the International Criminal Court in its investigation into Darfur?

Answer:   The International Criminal Court has not directed to the U.S. a specific request for assistance. UN Security Council Resolution 1593 recognized that "States not party to the Rome Statute have no obligation under the Statute." Additionally, as noted in our Explanation of Vote to Security Council Resolution 1593, there are legislative restrictions on our cooperating with the International Criminal Court under the American Service-Members Protection Act (ASPA).

We believe in accountability. It is important that the alleged perpetrators of crimes in Darfur be investigated and be held accountable. We expect the Government of Sudan to comply with United Nations Security Council Resolutions.
