A public meeting was held, under the auspices of the State Department’s Advisory Committee on Private International Law, on February 26, 2014, at the Department of State, Harry S Truman Building, Room 4835, 2201 C Street, NW, Washington DC. The meeting was chaired by a representative of the Office of the Assistant Legal Adviser for Private International Law.
Working Group II (arbitration and conciliation) of the United Nations Commission on International Trade Law (UNCITRAL) has completed its work on a Convention on Transparency in Treaty-Based Investor-State Arbitration, which will be considered by the UNCITRAL Commission in July 2014. Participants in the public meeting were asked to comment on tentative plans to have the Working Group update the UNCITRAL Notes on Organizing Arbitral Proceedings. Participants were also asked to identify possible future projects for the Working Group. Among the topics discussed in that regard were (1) the development of a convention on the enforceability of mediated settlement agreements and agreements to mediate; (2) the use of arbitration in insolvency proceedings; (3) concurrent arbitral proceedings; and (4) guidance to judges on UNCITRAL arbitration instruments.
