Public Meeting On Cross-Border Insolvency Law

A public meeting was held, under the auspices of the State Department’s Advisory Committee on Private International Law, on February 12, 2014, at the Department of State, Annex 4, South Building, 2430 E Street NW, Washington, DC. The meeting was chaired by a representative of the Office of the Assistant Legal Adviser for Private International Law.

Working Group V (insolvency) of the United Nations Commission on International Trade Law (UNCITRAL) held a colloquium in December 2013 to identify projects for future work. Among the many subjects discussed, several projects were selected as priorities for the Working Group: (1) facilitating insolvency proceedings for cross-border enterprise groups through the development of model legislative provisions; (2) the responsibilities of corporate directors in enterprise groups in the vicinity of insolvency; (3) the recognition and enforcement of insolvency-derived judgments; and (4) insolvency issues for micro, small, and medium enterprises.

Participants in the public meeting were asked to provide comments on each of these topics in advance of further Working Group consideration of the issues. No matter was resolved. No report was approved.
