GL Farms LLC, a Delaware corporation, and its President, Carl Adams, a U.S. national, filed a claim against the Government of Canada alleging harm to its dairy products business in the territory of Ontario due to milk transportation measures imposed by the Dairy Farmers of Ontario (DFO) and any measures taken by the DFO, the Ontario Farm Products Commission, the Ontario Agriculture, Food and Rural Affairs Appeal Tribunal or the Ontario Minister of Agriculture and Food in furtherance of the DFO measures. Claimants allege that Canada has violated NAFTA Article 1102 (national treatment), Article 1105 (minimum standard of treatment), Article 1502 (conduct of monopolies and state enterprises), and Article 1110 (expropriation).
