V.G. Gallo, a national of the United States and the legal and beneficial owner of 100% of the shares of 1532382 Ontario Inc. an Ontario corporation that owns and controls a former mine site in Northern Ontario, the Adams Mine Site, filed a claim against the Government of Canada in relation to the use of that land as a waste disposal site. Claimant alleges that the Ontario Legislature’s imposition of Bill 49, which prevents disposal of waste at the Adams Mine Site, and other measures taken by the Government of Ontario violate NAFTA Article 1105 (minimum standard of treatment) and Article 1110 (expropriation).
