Vessels Operating
in New Zealand Waters.
Released by the Department of State, Bureau of Oceans and International Environmental
and Scientific Affairs, December 1997.
OES/OA has been advised by our Embassy in Wellington that
they have received the following letter and attached form
from the Ministry of Foreign Affairs and Trade.
The stated New Zealand lead-time requirement is six months.
Therefore, it is requested that clearance requests be
submitted to the Department of State at least seven months
prior to the proposed start of research, and in compliance
with the "UNOLS Handbook for International Operations of
U.S. Scientific Research Vessels."

The Ministry of Foreign Affairs and Trade presents its
compliments to the diplomatic missions and consular posts
accredited to New Zealand and has the honor to set out the
guidelines and procedures for access to New Zealand ports
by foreign research vessels and/or to conduct marine
scientific research in the territorial sea of New Zealand,
the exclusive economic zone of New Zealand or on the
continental shelf of New Zealand. These guidelines and
procedures are in accordance with the United Nations
Convention on the Law of the Sea. Any matters not covered
by this Note are governed by Part XIII of the United
Nations Convention on the Law of the Sea.
The requirements outlined below apply to all research
vessels whether used for training or otherwise, including
training vessels and any other vessels which have a
research function or capacity. The Government of New
Zealand expects that in a situation where it is unclear to
a State whether the requirements apply to a particular
vessel that the State would request formal approval.
The Ministry wishes to advise that formal consent of the
Government of New Zealand must be obtained in advance for
visits to new Zealand ports by research vessels and
training vessels, whether or not they undertake research in
new Zealand's territorial sea, exclusive economic zone or
on New Zealand's continental shelf. A request for such
formal consent should provide sufficient information and
allow sufficient time to enable the Government of New
Zealand to make an informed decision.
The formal consent of the Government of New Zealand is also
required in advance for research vessels intending to
undertake marine scientific research in New Zealand's
territorial sea, exclusive economic zone or on the
continental shelf of New Zealand. The Ministry requests
that a formal request for consent together with the
application form set out in the Schedule to this Note are
submitted at least six months in advance of the expected
starting date of research activities in the territorial sea
or in the exclusive economic zone or on the continental
shelf of New Zealand through diplomatic channels to this
Ministry. Formal consent is also required for any change
in the research program or project from that set out in the
application form.
Should formal consent be granted for a vessel to undertake
marine scientific research in New Zealand's territorial
sea, exclusive economic zone or on New Zealand's
continental shelf it shall be subject to the conditions set
out below and such additional conditions as the Government
of New Zealand may impose:
(i) New Zealand scientific representatives are entitled,
if they wish, to participate in or be represented in the
marine scientific research project, especially on board
research vessels or other craft or scientific research
installations without payment of any contribution to the
costs of the project.
(ii) The following notices and information shall be
provided to the Fisheries Communication Centre: Telex
NZ30049; Facsimile +64 4 801 5381; Telephone +64 4 801
5782:
-- Twenty-four (24) hours prior notice of entry into or
exit from the New Zealand Exclusive Economic Zone (NZEEZ)
and New Zealand's Territorial Sea (NZTS) shall be given
providing the following information.
-- The position that the vessel intends to enter/exit
NZEEZ or NZTS to the nearest minute or the arc and
-- The time in New Zealand Standard Time (NZST) that
the vessel intends to enter/exit the NZEEZ or NZTS
-- Notice of the position of the vessel, to the nearest
minute of the arc, at noon and midnight while the vessel is
in the NZEEZ or NZTS.
-- Twenty-four (24) hours' prior notice of intended port of
call, the name of that port and the Estimated Time of
Arrival (ETA) to that port in NZTS.
-- Prior notice of Estimated Time of Departure (ETD) from
the port in NZTS.
-- All notices shall include the name and international
radio call sign of the vessel.
(iii) New Zealand scientific representatives shall have
access to all data and samples derived from the marine
scientific research project.
(iv) The following reports, data, samples and other
information are to be delivered to the Government of New
Zealand in a form acceptable to New Zealand, as soon as
possible, but not later than twelve months after the
conclusion of the research cruise in New Zealand water,
unless an explanation accounting for the delay and
specifying the anticipated date for delivery of the
reports, data, samples and information is provided in
writing prior to the expiry of the twelve month period and
this explanation is satisfactory to the Government of New
Zealand.
a) The preliminary report of the marine scientific research
project.
b) The final report containing details of the results and
conclusions reached from the marine scientific research
project.
c) Station positions to a high degree of accuracy and
details of data collected.
d) Details of types of data collected.
e) Copies of all underway survey data including operational
information and full navigational data. As much data as
practicable is to be in digital form with copies of the
original analogue record for bathymetric data and for other
data if they have been subsequently digitized.
f) Copies of all station data.
g) Charts showing tracks where underway data have been
collected.
h) Copies of all physical oceanographic data collected
during the marine scientific research project.
i) Copies of any biological or chemical data collected
during the marine scientific research project.
j) Sub-samples of sediment and other rock and biological
samples and sub-samples of all species represented in the
sample of biological material and the Holotype and at least
one Paratype of any new species described form biological
material collected during the marine scientific research
project.
k) Copies of any other data and samples arising from the
marine scientific research project not covered above.
l) Copies of any assessments of any data, samples of
research results.
The Ministry also wishes to advise that a consent to carry
out marine scientific research does not authorize the entry
of the research vessel into a Gazetted Marine Reserve. In
accordance with Section 11(b) of the Marine Reserves Act
1971 the Director General of Conservation must authorize
all scientific studies conducted in any marine reserve.
Applications to undertake a scientific study within a
marine reserve should be made at the same time as an
application for marine scientific research but should
circumstances preclude this, no later than four months in
advance and may be made to the Conservancy which manages
the marine reserve.
The above requirements do not affect existing approval
procedures for vessels other than research vessels.
The Ministry of Foreign Affairs and Trade takes this
opportunity to renew to the diplomatic missions and
consular posts accredited to New Zealand the assurances of
its highest consideration.
