U.S.-EU Eighth Record of Meeting of November 17, 2010 (contains a working reference document consolidating the 2007 Air Transport Agreement and the 2010 Protocol)
1. The eighth meeting of the U.S.-EU Joint Committee took place in Washington, D.C. on 16 November 2010. The lists of participants are at Attachment 1. The approved agenda is at Attachment 2.
2. The Joint Committee expressed appreciation to the Air Transport Association for the use of its facilities for this meeting.
3. The Joint Committee welcomed the development, by the Legal Working Group, of a consolidated text of the U.S.-EU Air Transport Agreement, as amended by the Protocol ("the Agreement") and approved it for use as a non-binding reference document. A copy of the approved consolidated text is at as Attachment 3.
4. The Joint Committee took note of the report of the Legal Working Group regarding the conditions and procedures for “accession” by Iceland and Norway to the Agreement, as amended by the Protocol. The Legal Working Group confirmed that the draft should be finalized before the end of 2010. The Joint Committee also took note of ongoing work on the development of criteria and mechanisms for determining whether countries have established a record of cooperation in air services relations, for purposes of investment liberalization, as well as for determining the countries to which airlines of the United States and the European Union might operate seventh freedom passenger-combination services. The Joint Committee asked the Legal Working Group to continue developing proposals on both these issues by June 2011.
5. The delegations welcomed the enhanced cooperation in security matters between the U.S. Transportation Security Administration (TSA) and the Commission, achieved within the Transportation Security Coordination Group (TSCG). This process is delivering concrete positive results in a spirit of enhancing air transport security and avoiding duplication. The delegations discussed cooperation in aviation security, detailed in Attachment 4.
6. The U.S. Department of Transportation (DOT) and the European Commission's Directorate-General for Competition presented the results of a joint report on competition issues and regulatory approaches with respect to transatlantic airline alliances. The delegations noted good coordination between competition authorities on both sides of the Atlantic, particularly with regard to remedies.
7. The EU delegation reported on current initiatives regarding slots and ground handling. The Commission is undertaking studies and consultations that will determine the extent to which legislative proposals on slots, ground handling, and noise will form part of a proposed airport package (that will include a report on airport capacity) the Commission intends to present to the European Parliament and Council of Ministers in the second quarter of 2011. The EU delegation stated that all stakeholders will have the opportunity to comment on any proposed regulations being developed by the Commission, and that any new regulations would be consistent with the Agreement.
8. On June 24, 2010, amendments to the Agreement extending additional rights to EU airlines affecting U.S. Government-procured transportation took effect. The General Services Agency has published a Federal Travel Regulation in the Federal Travel Bulletin.
9. The Federal Aviation Administration (FAA) reported that the FAA Reauthorization legislation is still pending in the U.S. Congress. Both the U.S. and EU delegations confirmed their intentions to conclude the U.S.-EU Aviation Safety Agreement without delay. The delegations also discussed various ways for which information will be shared among the participants of the recently signed Global Safety Information Exchange Memorandum of Understanding and look forward to further discussions during the Steering Committee meeting in Montreal on December 8.
10. The EU delegation reported that after public consultation on air passenger rights, the Commission will publish two reports, one on denied boarding, long delays and cancellation, the other on passengers with reduced mobility. The Commission might propose a review of the denied boarding Regulation. The U.S. DOT is developing expanded consumer protection rules that may apply to service between the United States and European Union. A final rule is anticipated in April 2011.
11. The delegations expect to hold the next meeting of the Joint Committee in June 2011 in Oslo. The European delegation also noted a standing invitation from the Government of Italy to host a future meeting in Rome.
