Elliott Associates, L.P. v. Republic of Korea

Elliott Associates, L.P., a limited partnership organized in Delaware, alleges that conduct by the Republic of Korea breached Korea’s obligations under KORUS Article 11.5 to accord fair and equitable treatment and under KORUS Article 11.3 to provide national treatment.  This arbitration is proceeding under the 2013 UNCITRAL Rules and is administered by the Permanent Court of Arbitration.
